I am very confused by this so i need some peoples opinion. Im only 20 years old and almost a year ago i was involved in a auto accident. I was on the side of the free way broke down, when another driver (not paying attention) swerved into the shoulder and hit me. I tore my AC ligament in my shoulder and also seperated it. Right up untill this accedent, i was training for a proffessional baseball showcase in Yuma arizona. It is called the ASL (Arizona Summer League) It is known for its oppertunity's in professional baseball. I was not able to attend due to the injury i sustained from the auto accident. The showcase cost me 2500 non refundable. Since the accident i have been on disability and not currently working. MY shoulder has a very uncomfortable "click" everytime i lift anything, or throw a baseball. There is a sergury that ,y doctor suggested but it is only a 50/50 chance it will help my injury. So i cant throw a baseball the way i use to, "talk about dreams since i was 5 years old out the window" and to top it im a pitcher. Also, my job is at a lumber yard. I might not be able to work heavy labor like that again. So with all that said, i went and got a lawyer. Once again, im 20 years old and have never been in a auto accident before. let alone talked to a lawyer, so i want to make sure this lawyer of mine isnt trying to pull some s*&t with me. My lawyer wrote up a demand letter and sent it to me. It looked like a 10 year old had written it. But, it was a "first draft" he said and he was going to be adding alot more information to it before he sent it. So a month passes buy and he tells me "the other side" says that they never recieved it and does not know where it is. So he sends it again, the "other side" says they will have a offer ready in 5 days. Five days passes and my lawyrs says that they emailed him saying they have no offer. so i call my lawyer and when i tell him its me my lawyer says "hey the other side sent me another email saying there was no offer because of a 15/30 cap" and they stated my case isnt worth that. My lawyer says were just going to file a lawsuit, the thing im wondering is could there be no offer becaue of a poor demand letter. Like the demand letter didnt have enough information. I just find it hard to believe no offer was made when i have probably 15k in just medical bills because of this injury. I lost my future in baseball, cant pitch the same. Wont be able to work heavy labor, and have to live with this injury for the rest of my life. But my lawyer says that there was no offer made because the other insurence company doesnt think my injury is worth 15k. I just think my laywer isnt telling me information that i need to know. Could my lawyer do anything besides fileing for a lawsuit? how long do lawsuits usually take? thanks... Read More »
